BMW's lawsuit against BYD, filed in February 2025, has been dismissed. The reasons are as follows.
KatadataOTO – On February 26, 2025, BMW AG filed a lawsuit against BYD for the use of the name M6.
The lawsuit was registered with case number 19/Pdt.Sus-HKI/Merek/2025/PN Niaga Jkt.Pst. on the Case Tracking Information System page.
It should be noted that the M6 is currently used as the name for an electric MPV (Multi Purpose Vehicle) from BYD, priced in the Rp 300 million range.
The BMW M6 is one of BMW's lineups that had previously hit the roads as a high-performance 6-series sedan from the German manufacturer.
However, it was recently revealed that BMW's lawsuit against BYD was rejected by the court.
Decided on June 25, 2025, the judge declared that the lawsuit from BMW as the plaintiff was inadmissible.
“To order the plaintiff to pay the court fees for this case amounting to Rp 1,070,000.00 (one million seventy thousand rupiah),” read the Supreme Court's decision statement, quoted on Tuesday (07/01).
However, as of the publication of this news, neither party has provided an official statement regarding the M6 trademark dispute.
For your information, BMW AG initially prepared seven petitions for the court to grant.
Among them was to affirm that the M6 trademark, previously registered with the DGIP (Directorate General of Intellectual Property) of the Indonesian Ministry of Law and Human Rights, belongs to BMW.
Furthermore, all activities involving the use of the M6 trademark related to automotive and other areas must be stopped. Then, it was requested that BYD Motor Indonesia be penalized and ordered to pay court costs.
On a separate occasion, a BMW representative stated that the lawsuit was filed out of consideration for BMW M6 customers, especially in the country.
“I cannot comment much, as the process is still ongoing. It is still very early to provide a comment,” said Jodie O’tania, Director of Communications for BMW Group Indonesia, on a different occasion some time ago.
If BMW had won the lawsuit, there was a chance BYD would have needed to change the name of the electric MPV already marketed in the country.
This would certainly have become a new obstacle, as many consumers already recognize the M6 as an EV (Electric Vehicle) from the Chinese manufacturer, BYD.
