Motorists Smoking on the Road Risk Losing Driver's License

For your information, Article 106 paragraph (1) of Law 22/2009 states, “Every person who drives a Motor Vehicle on the Road must drive the Motor Vehicle reasonably and with full concentration,” particularly concerning the phrase “full concentration”.

Meanwhile, Article 283 contains, “Every person who drives a Motor Vehicle on the Road unreasonably and engages in other activities or is influenced by a condition that results in a disturbance of concentration while driving as referred to in Article 106 paragraph (1) shall be punished with imprisonment for a maximum of 3 (three) months or a fine of a maximum of Rp 750,000.”

Syah Wardi considers the two articles above to be too weak and open to multiple interpretations, given that they are directly related to the protection and safety of human lives.

The punishment given also does not have a deterrent effect. Therefore, Syah Wardi is requesting additional sanctions for drivers caught smoking on the road.

“Violators who smoke while driving must be subject to additional sanctions in the form of social work cleaning highways or the revocation of their Driver's License (SIM) for a certain period of time,” concluded Syah Wardi.

The punishment above is intended as a form of accountability for the risk of danger posed to the public.
