KatadataOTO – Recently, news has circulated that not only motorcycles and cars will be subject to tickets from ETLE (Electronic Traffic Law Enforcement). However, pedestrians are also said to not be exempt from the system.
This issue immediately drew various responses from different groups. Many parties feel they would be disadvantaged if the ETLE system were actually implemented.
In response, the Polda Metro Jaya (Metro Jaya Regional Police) provided a clarification. They denied that the current ETLE ticketing system can penalize violations by pedestrians.
“ETLE can only depict the road situation (all activities on the road) and capture violations by motorized vehicle users, but not anything else yet,” said Police Commissioner Komarudin, Director of Traffic for Polda Metro Jaya, to Antara on Tuesday (27/05).
Furthermore, Komarudin mentioned that the rules regarding the rights and obligations of pedestrians are regulated in Article 131, Article 132, and Article 28 Paragraph 1 of Law Number 22 of 2009 concerning Road Traffic and Transportation.
In Article 131, it is explained that pedestrians are entitled to supporting facilities such as sidewalks, crosswalks, and others.
Second, they are entitled to priority when crossing at a crosswalk. If such facilities are not yet available, they are allowed to cross at a location of their choice, paying attention to safety aspects.
Meanwhile, Article 132 states that pedestrians must use the part of the road designated for them or the very edge.
Furthermore, if there is no crosswalk as referred to in paragraph 1 letter b, they must pay attention to the safety and smoothness of traffic.
Third, people with disabilities are required to wear a clear special sign to be easily recognized by other road users.
If a violation is committed by a pedestrian, Komarudin emphasized that they can be subject to legal sanctions based on Article 257.
The article states that anyone who causes a disturbance to traffic signs, road markings, signaling devices, pedestrian facilities, and road user safety equipment, as referred to in Article 28 paragraph (2), can be sentenced to a maximum of one month in prison or fined Rp 250,000.
Additionally, anyone who damages traffic signs, road markings, traffic signaling devices, pedestrian facilities, or road user safety equipment to the point that they no longer function, can be sentenced to a maximum of two years in prison or fined a maximum of Rp 50 million.
